ORDER:
1.The Andhra Pradesh Public Employment (Organization of Local Cadres and Regulation of Direct Recruitment) Order, 1975 (Presidential Order) was re-published vide G.O. 1st read above and it came into force with effect from 18-10-1975. For effective implementation of the Presidential Order, certain orders and instructions were issued from time to time clarifying the course of action to be taken. Government noticed certain deviations in the implementation of the Presidential Order and orders were issued for rectification of these, vide the G.O. 2nd read above.
2. Subsequently, One Man Commission (SPF) made recommendations for implementation of Presidential Order and G.O.Ms.No.610 , Dt: 30.12.1985. The Government decided to implement the G.O.Ms.No.610 Dt. 30-12-1985 strictly in letter and spirit in accordance with Presidential Order and keeping in view the recommendations/ suggestions detailed in the report of O.M.C vide reference 3rd cited above. Government issued further instructions vide 4th cited to furnish the information in respect of each Unit of Appointment about the locals and non- locals in various categories of posts.
3. Government have taken a decision to repatriate non-locals who are in excess of the prescribed ceiling for that category in accordance with Presidential Order. Accordingly, the Departments have taken up the exercise of collecting the information in respect of each employee covered under different local cadres by ascertaining their local status in accordance with the procedure prescribed in this regard. Further analysis has been done to find out the number of such persons who are in excess of the prescribed ceiling. The Administrative Departments of the Secretariat will identify specific persons who fall in this category of being in excess to the prescribed ceiling and take action for repatriating them to the cadre to which they are local by ordering “Inter Local cadre transfers“. The identification of persons to be repatriated shall be on the basis of “Last In First Go” from out of the excess Non-Local employees. Accordingly the following orders are issued:
(i) Such Inter Local cadre transfers resulting on this account shall be treated as transfers in Public Interest as provided under Para 5 (2)(c) of the Presidential Order, 1975. While undertaking these inter-local cadre transfers, if such employees opt for mutual transfer under Para 5(2) (d) of the Presidential Order, the same are also permitted to be undertaken. These inter-local cadre transfers shall be undertaken against a clear vacancy in the cadre to which the employee is being transferred.
(ii) In the absence of a clear vacancy in the Local Cadre to which such an identified employee is to be transferred, the Administrative Department may initially send such identified employee on deputation as per his consent or on other duty. Simultaneously the process for creation of supernumerary posts in that local cadre shall be initiated for obtaining orders of the Government. Each Administrative Department shall prepare a consolidated proposal for creation of supernumerary posts in this regard and such proposals may be finalized at the earliest and put up through Finance Department before the Cabinet within the next 15 days following the existing procedure in this regard.
(iii) The instructions regarding fixation of seniority of these employees transferred on Inter Local cadre basis will be issued separately.
(iv) In all inter-local cadre transfers, the concurrence of the Genl. Admn. (SPF) Dept. and circulation orders upto the Chief Secretary are required as per the instructions issued in U.O. Note No. 540/ SPF.A/ 96 -1, Dt. 17.9.1996. The Government hereby delegate the powers to the Administrative Secretary of the Department to effect such Inter Local cadre transfers. It is hereby ordered that in such cases of transfers necessitated because of the exercise undertaken in accordance with the instructions issued in reference 4 th cited above, the Departments may process the cases for inter-local cadre transfers and issue orders. It is hereby further ordered that in such of the above cases, it will be deemed concurrence of Genl. Admn. (SPF) Dept. and no separate concurrence will be required.
4. It is also hereby ordered that in case of Deputations/ O.D/ Tenure duty, the persons who are in excess of Fair Share Principle should immediately be repatriated to their respective parent Offices. The repatriation of such employees shall be done on the Principle of “First In First Go” from out of the employees who are in excess of Fair Share Principle. Administrative Departments will fill-up the required posts depending on Administrative contingencies strictly in accordance with the Fair Share Principle .
5. The ban orders on transfers issued by the Finance Department will not be applicable in such of the above inter local cadre transfers and the ban on transfers is relaxed from the date of issue of these orders upto 30 th June, 2007.
6. All the Departments are requested to take action accordingly and complete the exercise before 30th June, 2007 while simultaneously sending action taken reports to G.A. (MC) Department.
7. These orders are issued with concurrence of Finance Department vide their U.O. No. 14623-A/ 738/ A3/ SMPC/ 07, Dated 5-6-2007.
